The alleged victim of sexual assault against a Labor Party official still claims that lawyer Simon Mitchell learned of her allegations.

The whistleblower, a woman identified as "Sarah" in an article published by The Spinoff on Sept. 9, says she has a hard time understanding why Mitchell called her claims "false" and "not credible."

Emails sent between March 9 and May 21 were obtained on September 10, revealing that Labor had received information about the sexual assault allegations.
Sarah said the first of the three emails contained a document detailing the alleged sexual abuse, an attachment titled "sexual abuse experience discharge."
But Mitchell, who chaired the Labor Party staff inquiry, hired a computer forensics expert to find out whether the document had been attached.
He said that "the email has no attachment" and there is no evidence of the document.

The other two emails Sarah sent to Mitchell were also sent to two other members of the inquiry team, as well as the then Labor president Nigel Haworth and another New Zealand councillor.
The plaintiff alleges that Mitchell was present and complicit when she described the alleged sexual assault in a deposition during an interview in March.
Mitchell said that during the interview the appellant "did not say at any time that she had been sexually assaulted."
On Monday, Prime Minister Jacinda Ardern said QC Maria Dew had completed terms of reference for her inquiry, but they would not be made public at the request of the complainants and the defendant.

On Labour's handling of the complaints, Ardern said the party's Kensington Swan lawyers had almost finished working on whether it had acted correctly in handling the complaints.
The prime minister also said an experienced victims' advocate would be appointed to review the findings and put systems in place "to ensure this does not happen again".
Minister Pota Williams, who has experience in the sexual and family violence sector, will lead Labour's cultural change and bring in experts, Ardern added.
